Terms & Conditions

Yorkshire Design Associates (YDA) makes every effort to ensure that information provided by the company in the digital domain is accurate. However, YDA cannot guarantee this, and accepts no liability for any inaccurate information given via its website. YDA pursues a policy of continual development and improvement and as such, product specifications may be changed without prior notice. All dimensions listed herein are only nominal.

Prices

The current Price List annuls and replaces all previous lists. All prices are quoted exclusive of Value Added Tax however this total price is given in smaller print. All prices are quoted Ex Works and YDA reserves the right to charge for delivery to the customer's premises as below.

Descriptions

Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the position at the exact moment you place an order.

Sale & Purchase

All orders are subject to availability. Notification of cancellation of orders must be made in writing. YDA reserves the right to refuse orders of less than £50 in value. YDA reserves the right to charge for collection from the customer's premises and a 25% re-stocking fee.

Credit

All goods remain the property of YDA until the customer has paid all sums owing to YDA on any account. For Authorised Credit accounts Invoices shall be due for payment in full 30 days from the date of Invoice. YDA reserves the right to withdraw Credit facilities at any time and to seek immediate payment of all amounts due.

All designs and imagery used within the Internet site, publicity leaflets, advertising and publications is copyright Yorkshire Design Associates (Limited) and any reproduction must be authorised by YDA Directors.
Making A Purchase Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept credit card payment. You may send your credit card information via phone, fax, mail or over the Internet.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Payment

Payment for all orders is at point of sale and not at point of despatch.
All prices are exclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold;
To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
Payments are accepted by cheque payable to "Yorkshire Design Associates Ltd", Delta, MasterCard, Solo, Switch or Visa at the time of order, and no goods will be dispatched until full payment is received in full, unless otherwise agreed.
Shipping And Handling Delivery dates referred to in any quotation may be stated in writing by a duly authorised official of the Seller to be otherwise and the Seller shall not be under any liability to the Buyer in respect of any failure to deliver on any particular time, date or dates. Without prejudice to the foregoing, any stipulated time for delivery shall not run until the Seller has received all necessary information or other items to enable the Seller to being production of the goods.

Delivery shall be at the Buyer's premises unless otherwise stipulated or agreed by the Seller. If the Buyer collects the goods from the Seller's premises or the Seller's agent's premises as may occur from time to time then delivery shall be at the seller's premises. The Seller will charge for delivery unless the price is expressed as being inclusive of delivery charges.

If the Buyer refuses or fails to take delivery of goods tendered in accordance with the contract or fails to take any action necessary on its part for delivery and/or shipment of the goods the Seller shall be entitled to terminate the contract with immediate effect and/or dispose of the goods as the Seller may determine and/or recover from the Buyer any loss or additional costs (including without limitation any damage and storage costs) which result from such refusal or failure.

Unless otherwise expressly agreed the Seller may effect the delivery in one or in instalments. Where delivery is affected by instalment each instalment shall be treated as a separate contract and any failure by the seller to deliver any one or more instalments or at any claim by the Buyer in respect of any one or more instalments shall not entitle the Buyer to treat the contract as a whole as repudiated.

Delivery Schedule The dispatch date for a product will be confirmed on the order acknowledgement. We deliver most items from Monday to Friday between 9am-6pm.

All goods should be examined on delivery. Any loss or damaged goods must be noted on the delivery documents and a claim made in writing within 3 days. Neither YDA nor its carriers will accept claims for damages if the goods have been signed for as unexamined. YDA must be notified if deliveries cannot be accepted on pallets.

England, Scotland & Wales: Delivery charges will vary dependant on size, weight and distance from YDA. Once agreed, these will form part of the purchase price. Orders of less than £400 in value will incur carriage charges with a minimum charge of £60.

Northern/Southern Ireland: Delivery charges will vary dependant on size, weight and distance from YDA. Once agreed, these will form part of the purchase price. Please call for details of carton delivery pricing. YDA reserves the right to levy a surcharge for delivery of bulky items. The customer's agreement will be sought prior to such despatch.
Back Orders If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
Tax Charges For orders made from the UK or the European Union, current rate VAT is added. All other orders are VAT free.
Credit Card Security When the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

Returns Policy Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm.

In the unlikely event that the customer is unhappy with the goods supplied, they can be returned to the YDA premises within 14 days of purchase and the purchase price will be refunded in full on confirmation that the goods are in the same condition as delivered. Without exception no goods will be accepted after 14 days. Damages and incorrect deliveries must be notified to YDA within 3 days of receipt. A customer advisor is on hand Monday to Friday 09:00-16:00 hours on 01423 863097. Where payment is made on credit/debit card any refund will be to the same account. A 25% re stocking charge may apply. On cancellation you must return the goods at a cost to you unless the goods are being returned because they are faulty.

Bespoke handcrafted furniture that is not faulty can not be returned. For these kind of purchases you will be contcted and a contract / agreement will be made and agreed between you and YDA prior to the order.
